Roblox is facing major criticism after arguing that an 8-year-old girl and her family agreed to its Terms of Use “no less than 28 times.”
The company is asking a Kentucky federal court to move a wrongful-death lawsuit into private arbitration instead of allowing it to continue as a public court case.
What Is the Roblox Lawsuit About?
The lawsuit was filed by Jaimee Seitz, the mother of Audree Heine, a 13-year-old girl from Northern Kentucky who died by suicide in December 2024.
Seitz claims Roblox exposed Audree to harmful and violent online influences, even though parental controls were being used. Discord and TikTok are also named in the lawsuit.
Why Does Roblox Mention 28 Agreements?
Roblox argues that Audree and her family accepted the platform’s Terms of Use several times. This allegedly happened when:
- The Roblox account was created
- Updated terms were accepted
- Roblox gift cards were redeemed
- Robux was purchased
Roblox reportedly counts 19 Robux purchases as separate agreements to its terms. Together with the other actions, the company says there were 28 acceptances.
What Does Private Arbitration Mean?
Roblox’s Terms of Use include an arbitration clause. Arbitration is a private way of solving a legal dispute outside a normal courtroom.
If the judge agrees with Roblox, the case could be handled privately by an arbitrator instead of being heard by a public jury.
Why Are People Criticizing Roblox?
Roblox says its terms were clearly shown and that Audree repeatedly accepted them. However, critics question whether an 8-year-old can understand complex legal terms or knowingly give up the right to sue a major company.
